Terms of Service

These Terms of Service ("Terms") govern your use of Kulma ("Service"), operated by Kulma ("we," "us," or "our") at kulma.co. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Kulma does
Kulma is a subscription service that connects to your Google Analytics 4 (GA4) property — and optionally your Google Search Console account — using read-only OAuth access granted by you. Each week, Kulma pulls your analytics data, analyzes it using an AI language model, and delivers a concise action-oriented brief to your email address and, on qualifying plans, to your team's Slack or Microsoft Teams workspace.
The brief summarizes what changed in your data, why it matters, and what you might do about it. It is provided as an informational tool to support your marketing decisions — not as professional marketing, financial, or legal advice.
2. Eligibility and accounts
You must be at least 18 years old and authorized to use the Google Analytics and Search Console properties you connect. If you are accepting these Terms on behalf of a business, you represent that you have the authority to bind that business.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at support@kulma.co if you suspect unauthorized access.
3. Google data access
Kulma requests read-only access to your Google Analytics 4 data and, where you choose to connect it, your Google Search Console data. We never request write permissions to any Google service.
By connecting your Google account, you authorize Kulma to:
- Read aggregated metrics and dimensions from the GA4 properties you select (e.g., sessions, users, page views, conversions, acquisition channels, device categories).
- Read performance data from Search Console, including query, page, and impression data, if you connect that integration.
- Store the analytics payload required to generate, display, and retain your reports within Kulma.
Kulma does not access, read, or store raw user-level event data or personally identifiable information from your GA4 property. All data pulled from GA4 is at the aggregated property level as provided by the Google Analytics Data API.
Your use of Google services through Kulma is also subject to Google's Terms of Service and the applicable Google API Services User Data Policy. You may revoke Kulma's access to your Google account at any time through your Google account permissions.
4. Your obligations
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Share your account with third parties or resell access to the Service without our written consent.
- Attempt to reverse-engineer, scrape, or systematically extract data from the Service.
- Connect Google properties that you do not have authorization to access.
- Submit false, misleading, or fraudulent information to us or to Stripe during payment.
- Interfere with or disrupt the integrity or performance of the Service.
You are responsible for ensuring that your use of GA4 data within Kulma complies with your own privacy policy and applicable data protection obligations to your end users.
5. Subscriptions and payment
Free trial. New accounts may access a free trial period as specified at sign-up (currently 14 days). No payment method is required to start a trial, but a valid payment method is required to continue after the trial ends.
Paid plans. After the trial, continued access requires an active paid subscription. Subscription fees are billed monthly or annually as selected at checkout, in advance. All fees are in US dollars unless otherwise stated.
Payment processing. Payments are processed by Stripe. By subscribing, you agree to Stripe's terms. We do not store your full payment card details.
Renewals and cancellation. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period — you retain access until then.
Refunds. We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact support@kulma.co within 14 days of the charge.
Plan changes. Upgrades take effect immediately and are prorated. Downgrades take effect at the next renewal date.
Price changes. We may change subscription prices with at least 30 days' notice. Continued use of the Service after the price change constitutes acceptance of the new pricing.
6. Data and privacy
Our Privacy Policy describes how we collect, use, and protect your data. By using the Service, you agree to the collection and use of information as described in the Privacy Policy.
Report content and analytics payloads are retained until you delete them or request account deletion. You may request deletion of all account data at any time by contacting privacy@kulma.co. We process deletion requests within 30 days.
We use an AI language model to generate weekly brief narratives. Aggregated analytics metrics are sent to this model for that purpose. Under our data processing agreements, this data is not used to train future model versions.
7. Intellectual property
The Kulma service, including its software, design, and brand, is owned by us and protected by copyright and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or logos.
You retain ownership of the data you bring to the Service (your GA4 and Search Console data). You grant us a limited license to access and process that data solely to provide and improve the Service for you. We do not use your property-specific data to train AI models or for any purpose other than providing your reports.
Report briefs generated for your account belong to you. You may share, print, or use them for your own business purposes.
8. Disclaimer and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that reports will be free of inaccuracies. Analytics insights are generated by AI and are not a substitute for independent business judgment.
To the fullest extent permitted by law, our total liability to you for any claims arising from or related to the Service will not exceed the greater of (a) the amount you paid us in the three months immediately preceding the claim, or (b) US $50.
In no event will we be liable for any indirect, incidental, punitive, consequential, or special damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by applicable law.
9. Termination
By you. You may cancel your account at any time through your account settings. Cancellation ends your subscription at the close of the current billing period.
By us. We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. We may also discontinue the Service with 30 days' notice.
On termination, your right to access the Service ceases. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8, and 10) will do so.
10. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
If you are accessing the Service from outside the United States, you are responsible for compliance with your local laws.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your account before the effective date.
The date at the top of this page reflects when the Terms were last updated.
